Terms of Use
1. Agreement
These terms are a contract between you and Blake Olinger-Royer ("we", "us") about your use of The Side Quest app and this website. By creating an account or using the app you agree to them and to our Privacy Policy. If you don't agree, don't use The Side Quest.
2. Who can use it
The Side Quest is rated 17+. You must be at least 17 years old and able to form a binding contract where you live. It is not directed to children.
3. Your account
You sign in with Apple. Choose a display name that isn't misleading or offensive. You're responsible for what happens under your account, so keep your device secure. Tell us at once if you think someone else is using your account.
4. Playing games
- Games are invite-only. Join only games you were invited to, and share invite codes only with people you want to play with.
- The host runs the game and can adjust scores, resolve disputes, and remove players. Other players agree to play by the host's calls within these terms.
- Points, rankings, and Quest Coins have no cash value.
5. Safety in the real world
The Side Quest is played in public places, on foot or by transit. Cards are ideas for a game, never a reason to do something unsafe or unlawful.
- You are responsible for your own safety and for anyone you're responsible for. Skip any card that feels unsafe.
- Obey the law. Don't trespass, enter staff-only areas, climb structures, step into traffic, or play while driving.
- Respect other people. Don't photograph identifiable people without their consent, and don't bother staff or bystanders.
- Don't buy or drink alcohol, or use anything age-restricted, because a card told you to. No card asks for it.
- Stay aware of your surroundings and the weather, and stop playing if someone needs help.
To the extent the law allows, you play at your own risk, and we are not responsible for what happens to you or others while playing.
6. Photos and other content you submit
- You keep ownership of what you submit. You give us a limited license to store, process, and show it to the players in your game as the game requires, and to review it if it is reported. The license ends when the content is deleted, which happens 7 days after the game ends or when you delete your account, except for copies we must keep to handle a report or as the law requires.
- You promise that you have the right to submit it and that anyone identifiable in it has agreed.
- Don't submit anything illegal, hateful, harassing, threatening, sexually explicit, or that shows someone without their consent, or anything that puts someone in danger.
7. Acceptable use
Don't:
- harass, threaten, or impersonate other people;
- cheat, for example by changing your device clock, using modified copies of the app, or exploiting bugs, and don't submit proof that isn't yours or wasn't made for that challenge;
- interfere with or attack the service, or try to access data that isn't yours;
- copy, scrape, reverse engineer, or resell the app or its cards, except as the law allows;
- use The Side Quest for anything unlawful.
8. Reports and enforcement
Players can report content and block other players. We may remove content, warn you, restrict features, or suspend or end accounts that break these terms or put others at risk, with or without notice where the situation calls for it. To appeal, email contact@mobileside.quest.
9. Purchases
Some features, such as creating games as host, may be unlocked with in-app purchases. Apple processes payments and handles refund requests under its own policies. Prices and what a purchase includes are shown before you buy.
10. Our content
We own the app, the card text, the design, and the name The Side Quest, apart from the rights you keep in your own content. We give you a personal, non-exclusive, non-transferable license to use the app for its intended purpose. If you send us feedback, we may use it without owing you anything.
11. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, and isn't responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms as they apply to the app, and may enforce them against you. You must also follow the Apple Media Services Terms and any other Apple terms that apply to you.
12. Disclaimers
The Side Quest is provided "as is" and "as available". We don't promise it will always work, be error-free, be available everywhere (including without a data connection or on airplanes), or that every card will suit every place. The app is a game, not a safety or navigation tool, and must not be relied on in an emergency.
13. Limits on our liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special, or consequential losses, or for loss of data or profits, arising from your use of The Side Quest, and our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim (or, if you paid nothing, a nominal sum). Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer under mandatory local law.
14. Ending your use
You can stop using The Side Quest at any time and delete your account from Settings (see Delete your account). We may suspend or end your access as described in section 8, or if we stop providing the service. Sections that by their nature should survive (such as 10, 12, 13, and 16) will.
15. Changes
We may update the app and these terms. If a change to these terms is material, we'll tell you in the app or by another suitable means before it takes effect. Continuing to use The Side Quest after that means you accept the updated terms.
16. Governing law
These terms are governed by the laws of the place where Blake Olinger-Royer is established, without regard to conflict-of-law rules. Mandatory consumer protection laws of the country where you live still apply to you.
